Consumer Information Notice

Dear Customer:

                As of November 19, 2001 the New Jersey DEP Pesticide Control Program instituted a new program that requires us to provide customers with information about the pesticides we will be using as part of the pest control program for your property. This consumer information notification lists any label precautions for the pesticides listed below that you should be aware of.  You should also be aware that you may request notification of the exact date(s) of any pesticide application, and a copy of the label for each pesticide that will be used.

If applications are made to turf, at least one sign will be placed on your property that says PESTICIDE TREATED AREA and contains the international signage for KEEP OFF THE GRASS. The sign(s) will be in place at the start of the application and may be removed after 72 hours.  To help keep the cost of this program at a minimum, we are requesting that our customers be responsible for removing the sign(s) no sooner than 72 hours following each application. We would appreciate it if you would do so.

TERMS OF SALE

Guarantee- Apple Earth Care LLC agrees to control insects and weeds in addition to promoting healthy turf.  Otherwise, we will re-apply the product FREE of charge. (This guarantee is good for the period we are applying the product and takes into account the progress of the turf and the initial time assigned for controlled maintenance. We will not guarantee the performance of any material beyond its federal label.)

Product Type- Products applied to your lawn are produced for professional application only and cannot be purchased from any store for private use.  All products used are authorized for professional application in the State of New Jersey.

Weather- Apple Earth Care LLC is required to provide you with projected service dates in advance. Weather conditions will vary your projected service date(s).  Please call our office anytime for updates on your projected service dates. Our products can be applied in limited wind conditions because of the carrier and weight that goes into the formulation process. Certain products can be applied in extreme heat while others cannot.  Some products improve performance if applied prior or during rain.  Please call our office for current product updates anytime.

Safety- All products used by Apple Earth Care LLC are applied by licensed professionals.  Should you require notification prior to any application, it must be noted on your original contract proposal.  Children and pets should remain off treated areas until the product is watered in or dry (usually with proper conditions this could take a minimum of 24 hours).

Payment and Scheduling- APPLE EARTH CARE LLC will renew all contracted services each successive year unless notified in writing by the customer.  Should you decide that you no longer want service, cancellation can only be made in writing (no phone calls will be accepted).  Upon receipt of your notice, we will promptly cancel service.  Payments are due and payable upon receipt of invoice.  A finance charge of 5% per month will be added to all past due balances after 30 days.  If account is overdue 60 days, Apple Earth Care LLC reserves the right to place all services on hold.  If services are placed on hold, APPLE EARTH CARE LLC will not be held responsible for any work not completed or the resulting effects of an incomplete turf management program.  In the event collection is placed in the hands of an attorney, the buyer agrees to pay all fees, legal costs, and reasonable attorney’s fees.

Reseeding Guarantee- Reseeding is an additional service.  Should you accept a seeding proposal, APPLE EARTH CARE LLC agrees to guarantee the germination and survival of newly planted grass seed for a period of one year or as long as the lawn is under APPLE EARTH CARE LLC care: providing that the customer follows the directions and instructions provided by APPLE EARTH CARE LLC pertaining to recommended customer follow-up care.  These customer supervised care issues include but are not limited to proper watering, mowing, limiting pet and/or pedestrian traffic, construction and/or damage done by machinery not operated  by employees of Apple Earth Care LLC.

Please Note: No verbal agreement or statements of any kind can supersede this policy or agreement.  As the customer I certify that APPLE EARTH CARE LLC has provided me all the information required under the NJDEP Pesticide Control Program’s notification program.  I have read the information supplied and understand my rights and responsibilities under this program, and my signature on a service contract or any electronic reply of approval signifies my acceptance and receipt of a copy of both the Consumer Information and the Terms Of Sale.
